HIGHSCHOOLTABLOID.COM TERMS OF USE AGGREMENT

IF you register to become a member of HighSchoolTabloid.com or visit HighSchoolTabloid.com you agree to these terms of use.

Effective Date: April 2010

This Terms of Use Agreement sets forth the standards of use of HighSchoolTabloid. By using the HighSchoolTabloid website you agree to these terms and conditions. If you do not agree to the terms and conditions of this agreement, you should immediately cease all usage of this website. We reserve the right, at any time, to modify, alter, or update the terms and conditions of this agreement without prior notice.  Modifications shall become effective immediately upon being posted at HighSchoolTabloid.com. Your continued use of the Service after amendments are posted constitutes an acknowledgement and acceptance of the Agreement and its modifications. Except as provided in this paragraph, this Agreement may not be amended.

1. Description of Service

HighSchoolTabloid is an internet magazine for High School students which allows members to post their own stories, upload pictures and videos, and post comments and reviews on content that has been posted by other members or visitors. Members and visitors must provide (1) all equipment necessary for their own Internet connection, including computer and modem and (2) provide for Member’s access to the Internet, and (3) pay any fees relate with such connection.

Eligibility for Membership

Use of HighSchoolTabloid services and registration to become a Member for the HighSchoolTabloid Services is void where prohibited.  By using the HighSchoolTabloid Services, you represent and warrant that all registration information you submit is truthful and accurate; you will update the accuracy of such information; you are 13 years of age or older; and your use of the HighSchoolTabloid Services does not violate any applicable law or regulation. Your account may be deleted and your Membership may be terminated without warning, if we believe that you are under 13 years of age.

Fees. Membership at HighSchoolTabloid.com is free; HighSchoolTabloid reserves the right to charge services and to change its fees at its discretion.  At HighSchoolTabloid’s sole discretion we may change our services at any time.

Password. HighSchoolTabloid members are responsible for keeping their password confidential. You agree to notify HighSchoolTabloid for any unauthorized use of your account or password.  You as a member of HighSchoolTabloid are responsible for all use of your account.

Member/Visitor Conduct

HighSchoolTabloid is not responsible for content posted on HighSchoolTabloid.com. HighSchoolTabloid does not monitor content posted by members or visitors. HighSchoolTabloid at it’s discretion does have the right to monitor, edit, remove content posted by members or visitors. You agree that you shall not upload, post, transmit, distribute or otherwise publish through this website any content that is: unlawful, libelous, defamatory, obscene, abusive, racist, hateful, constitutes or advocates illegal or violent activity, harassing or exploits people in a sexual or violent manner, pornographic, inflammatory, or tends to mislead or reflect unfairly on any person, business or entity; You agree that you shall not upload, post, transmit, distribute, or otherwise publish any content that violates, plagiarizes or infringes any rights of any entity or person, including copyrights, trademarks, patents, rights of publicity or privacy or any other proprietary rights.

Proprietary Rights in Content on HighSchoolTabloid.com

HighSchoolTabloid does not claim any ownership rights in the text, files, images, photos, video, sounds, music, applications, or any other materials that members, visitors or users post on or through the HighSchoolTabloid Services. After posting your Content on HighSchoolTabloid you continue to retain any such rights that you may have in your content, subject to the limited license herein.  By displaying or posting any content on or through the HighSchoolTabloid Services, you hereby grant to HighSchoolTabloid a limited license to use, modify, delete from, add to, publicly perform, publicly display, reproduce, and distribute such content solely on or through the HighSchoolTabloid Services, including without limitation distributing part or all of the HighSchoolTabloid website in any media formats and through any media channels. This limited license does not grant HighSchoolTabloid the right to sell or otherwise distribute your content outside of the HighSchoolTabloid Services.

HighSchoolTabloid disclaims all warranties with regard to the information provided, including the implied warranties of merchantability and fitness for a particular purpose, and non-infringement. HIGHSCHOOLTABLOID SHALL NOT be liable for any damages whatsoever, and in particular High School Tabloid shall not be liable for any special, indirect, consequential, or incidental damages, or damages for lost profits, loss of revenue, or loss of use, arising out of or related to this web site or the information contained in it, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if High school Tabloid has been advised of the possibility of such damages. SOME JURISDICTIONS DO NOT ALLOW FOR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, THEREFORE SOME OF THE ABOVE LIMITATIONS IS INAPPLICABLE.

1. Indemnification

Members and visitors agree to indemnify and hold HighSchoolTabloid, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable attorneys’ fees and costs, made by any third party due to or arising out of Member’s use of the Service, the violation of this Agreement, or infringement by Member, or other user of the Service using Member’s computer, of any intellectual property or any other right of any person or entity.

1. Modifications and Interruption to Service

HighSchoolTabloid reserves the right to modify or discontinue the Service with or without notice to the Member or visitor. HighSchoolTabloid shall not be liable to Members, visitors or any third party should HighSchoolTabloid exercise its right to modify or discontinue the Service. Member and visitors acknowledges and accepts that HighSchoolTabloid ighHHdoes not guarantee continuous, uninterrupted or secure access to our website and operation of our website may be interfered with or adversely affected by numerous factors or circumstances outside of our control.

If any provision of this Terms of Use Agreement shall be unlawful, void or unenforceable for any reason, the other provisions (and any partially-enforceable provision) shall not be affected thereby and shall remain valid and enforceable to the maximum possible extent.  You agree that this Terms of Use Agreement and any other agreements referenced herein may be assigned by HighSchoolTabloid, in our sole discretion, to a third party in the event of a merger or acquisition.  This Terms of Use Agreement shall apply in addition to, and shall not be superseded by, any other written agreement between us in relation to your participation as a Member or visitor.  Member or visitor agrees that by accepting this Terms of Use Agreement, Member or visitor is consenting to the use and disclosure of their personally identifiable information and other practices described in our Privacy Policy Statement.
